You do not need an account to send a notice. Use the form below, email, or mail. Include the information described here; an email or mailed notice does not need to use our form.
Infringement notices
Identify the copyrighted work, the material you want removed, and information reasonably sufficient for us to locate it on Prezzley. Include your name, postal address, telephone number, email if available, and physical or electronic signature. Include a good faith statement that the use is not authorized by the owner, its agent, or the law, and a statement that the information is accurate and, under penalty of perjury, you are authorized to act for the owner of the exclusive right allegedly infringed.
We review notices and may request missing information. When appropriate, we remove or disable access to identified material and take reasonable steps to notify the user. Restrictions can cover copies and derived collages on Prezzley. We cannot remove material from an outside retailer’s website.
Counter-notices
If your material was removed by mistake or misidentification, you may send a counter-notice. Identify the removed material and where it appeared, provide your name, address, telephone number and signature, and state under penalty of perjury your good faith belief that removal resulted from mistake or misidentification. Consent to the jurisdiction of the Federal District Court for your address, or, outside the United States, any judicial district in which Prezzley may be found, and accept service of process from the original complainant or their agent.
We forward a valid counter-notice to the complainant, including contact information. Subject to applicable law, material may be restored between 10 and 14 business days after receipt of a valid counter-notice unless we receive notice that the complainant has filed an action seeking a court order to restrain the user’s infringing activity. Independent restrictions may still apply. Knowingly making material misrepresentations in notices or counter-notices may result in liability.
Repeat infringement and records
In appropriate circumstances, Prezzley suspends or terminates accounts of repeat infringers. We review notice history, counter-notices, withdrawals and reversals; an unverified allegation alone does not automatically suspend an account. We accommodate and do not interfere with qualifying standard technical measures as required by applicable law.
We restrict access to copyright case records. We retain records as necessary to handle notices, disputes, legal obligations and enforcement, including where an account is deleted, and review continued retention periodically. Notices may be shared with affected parties as described above; do not include unrelated sensitive information.
